These terms apply when a consumer purchases goods from Clementine Furniture through our website. Please read them before placing an order. Nothing in these terms affects your statutory consumer rights.

2. OUR FURNITURE
Our furniture is handmade from solid hardwood, principally oak and walnut. Timber is a natural material, so every piece has its own grain, colour and markings. Knots, mineral markings and reasonable variations in grain and colour are normal characteristics of natural wood.
Wood responds to changes in temperature and humidity. Furniture should be kept away from excessive heat, damp, strong direct sunlight and sudden environmental changes.
These natural characteristics are not normally faults. This does not limit your rights if an item is faulty, damaged, unsafe, not fit for purpose or materially different from its description.
We make reasonable efforts to display products accurately, although colours can appear differently on different screens.
3. PRODUCT MEASUREMENTS AND OPTIONS
Please check all measurements and selected options carefully before ordering.
Where you choose a height, material, seat size or finish from the options normally offered on our website, the item remains part of our standard product range even though it is made after you order.
If you request an individual specification that is not normally offered on our website, the item may be treated as bespoke. We will tell you before accepting the order if we consider it bespoke and explain how this affects your cancellation rights.
We manufacture furniture according to the measurements and options shown in the order confirmation. Please contact us promptly if anything in the confirmation is incorrect.
Handmade furniture may have small, reasonable dimensional tolerances that do not affect its appearance, comfort or proper use.
4. PLACING AN ORDER
When you place an order, you offer to purchase the selected goods under these terms. A contract is formed when we send confirmation that your order has been accepted.
Please check the order confirmation and contact us immediately if any detail is wrong.
We may decline or cancel an order before acceptance if a product is unavailable, there is an obvious pricing or description error, we cannot deliver to the supplied address, or we cannot complete the order within a reasonable period. If we cancel after taking payment, we will refund the amount paid.
5. PRICES AND PAYMENT
Prices are in pounds sterling and include applicable UK VAT.
Any delivery charge or other mandatory cost will be shown before you place the order. We currently provide free delivery to eligible mainland UK addresses, subject to the delivery information on our website.
Payment is taken using the methods offered at checkout. A later price change will not affect an accepted order, except where there is an obvious error that you reasonably should have recognised.
6. PRODUCTION AND DELIVERY
Our current estimated production or dispatch time is displayed on the website. Timescales are estimates unless we expressly agree a fixed delivery date.
We will contact you if a significant delay becomes likely. Your legal rights concerning late delivery, including any right to set a reasonable additional deadline or cancel, are unaffected.
Delivery is complete when the goods are delivered to the supplied address or to a person you nominated to receive them. Responsibility for the goods passes to you on delivery.
Please ensure that doors, stairs, access routes and the intended location are suitable for the product’s dimensions.
7. CHECKING YOUR DELIVERY
Please inspect the furniture as soon as reasonably possible after delivery.
If an item arrives damaged, incomplete or incorrect, contact us promptly and provide photographs where reasonably possible. This helps us investigate and arrange an appropriate remedy. A delay in reporting a problem does not remove your statutory rights.
8. CANCELLING AN ELIGIBLE ONLINE ORDER
For products selected from the standard options offered on our website, consumers will normally have the right to cancel without giving a reason.
The cancellation period ends 14 days after the day on which you, or a person nominated by you, receives the goods. If an order is delivered in separate parts, the period runs from receipt of the final part.
To cancel, email clementinefurniture2020@gmail.com with a clear statement that you wish to cancel. You may use the cancellation form at the end of these terms, but you do not have to. Please include your name, order number and contact details.
You must tell us within the cancellation period and return the goods within a further 14 days.
9. BESPOKE PRODUCTS
The statutory change-of-mind cancellation right does not normally apply to goods made to a customer’s genuinely individual specification or clearly personalised for them.
This exception will not be applied merely because an item is manufactured after the order is placed. Choosing from the heights, materials, seat sizes or finishes normally offered on our website will not automatically make an item bespoke.
Where an order involves a genuinely non-standard specification, we will identify it as bespoke before accepting it.
This exception does not affect your rights where bespoke goods are faulty, damaged, unsafe, not fit for purpose or not as described.
10. RETURNING CANCELLED GOODS
Unless goods are faulty, damaged or incorrect, you are responsible for arranging and paying for their return.
Based on current typical courier prices, returning one stool is estimated to cost approximately £13. The actual cost will depend on the carrier, destination and number of items.
Please contact us before returning furniture so that we can provide return instructions. Goods must be sent back within 14 days after you tell us you are cancelling.
Please take reasonable care of the goods and, where practical, use their original protective packaging. You may inspect them as you would in a shop, but we may make a lawful deduction if their value has been reduced by handling beyond what is reasonably necessary to establish their nature, characteristics and function.
11. REFUNDS FOLLOWING CANCELLATION
For an eligible cancellation, we will refund the price paid and the cost of our least expensive standard delivery option where a delivery charge was originally paid.
We may withhold the refund until we receive the goods or you provide evidence that they have been returned, whichever happens first.
We will issue the refund within 14 days of that date, using the original payment method unless agreed otherwise.
12. FAULTY, DAMAGED OR INCORRECT GOODS
By law, goods must be as described, of satisfactory quality and fit for any purpose made known to us.
If furniture does not meet these requirements, you may be entitled to remedies including rejection and refund, repair, replacement or a price reduction, depending on the circumstances and the time that has passed.
We will bear reasonable return or collection costs where goods are faulty, damaged on arrival or supplied incorrectly. Contact us so that we can assess the problem and arrange an appropriate remedy.
13. CHANGES REQUESTED AFTER ORDERING
Contact us as soon as possible if you wish to change an order. We may be able to accommodate a change before production has progressed, but this cannot be guaranteed.
If a requested change makes the order genuinely bespoke, we will explain the effect on cancellation rights before agreeing to it. Any change to the price or delivery estimate must be agreed before we proceed.
14. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay or failure caused by circumstances outside our reasonable control, provided that we take reasonable steps to minimise the effect and keep you informed.
If a substantial delay occurs, we will explain your options, which may include agreeing a revised delivery date or cancelling the affected order for a refund. This section does not limit rights given to you by law.
15. OUR RESPONSIBILITY TO YOU
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We do not exclude or limit responsibility where doing so would be unlawful, including responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breaches of statutory consumer rights.
We are not responsible for losses relating solely to a business, including loss of profit, revenue or business opportunity, where you purchase as a consumer.
16. PERSONAL INFORMATION
We use personal information in accordance with our Privacy Policy. Payments are processed using the payment services offered through our website. We do not directly store your full payment-card details.

18. CHANGES TO THESE TERMS
We may update these terms from time to time. The terms that apply to your purchase are those in force when your order is accepted. A later change will not retrospectively alter an existing contract unless required by law or expressly agreed with you.
19. GOVERNING LAW
These terms are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections provided by the law where you live and may normally bring proceedings in the courts of that part of the United Kingdom.
20. SEVERABILITY
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
